Terms of Service for Fear Farm Haunt

Effective Date: 09/04/2025

By purchasing a ticket and/or entering Fear Farm Haunt, you agree to the following terms and conditions. Please read carefully, as these terms govern your participation in the event and your legal rights.

1. Assumption of Risk & Hold Harmless Agreement

By attending Fear Farm Haunt, all participants understand and acknowledge that haunted attractions involve intense and potentially frightening environments, including but not limited to dark barns, cornfields, uneven farm terrain, loud noises, fog, strobe lights, sudden scares, and actors in close proximity. You voluntarily assume all risks associated with participation, including the risk of personal injury, property damage, or death.

Fear Farm Haunt, its owners, operators, affiliates, employees, and contractors shall not be held liable for any injuries, accidents, illnesses, property damage, emotional distress, or any other harm that may occur before, during, or after participation in the event.

By purchasing a ticket and entering the premises, you agree to hold Fear Farm Haunt and its owners harmless from any claims, demands, or lawsuits arising from participation in the event, including negligence on the part of Fear Farm Haunt.

2. Ticket Policy

  • All ticket sales are final. No refunds will be issued once a ticket is purchased.

  • Tickets may be transferred to another operating date within the same season if the ticket has not been scanned.

  • Fear Farm Haunt is not responsible for lost or stolen tickets. Ticket holders are responsible for securing their tickets.

  • By purchasing a ticket, you are agreeing to our “Waiver and Release, Express Assumption of Risk, Indemnity, and Voluntary Consent Agreement.”

3. Code of Conduct

By entering Fear Farm Haunt, all guests agree to follow posted safety rules:

  • No touching of actors, staff, or props. Violation may result in removal without refund.

  • Intoxicated or impaired guests will be denied entry or removed without refund.

  • Aggressive, disruptive, or unsafe behavior will not be tolerated.

  • Proper footwear is required; farm terrain may be uneven or muddy.

4. Ticket Holder’s Responsibility

Guests are responsible for following all posted warnings and staff instructions. Adults accompanying minors are responsible for ensuring minors comply with rules. Fear Farm Haunt reserves the right to refuse entry or remove guests without refund for rule violations.

5. Photography & Video

By entering, you consent to being filmed, photographed, or recorded for marketing and promotional use by Fear Farm Haunt without compensation.

6. Force Majeure

Fear Farm Haunt is not liable for cancellations or delays caused by circumstances beyond its control, including severe weather, natural disasters, or other unforeseen events. Tickets may be honored on a future date, subject to availability.

7. Indemnification

You agree to indemnify and hold harmless Fear Farm Haunt, its owners, employees, and contractors against any claims, including attorneys’ fees, arising from your participation or violation of these terms.

8. Governing Law

These Terms of Service are governed by the laws of California. Any disputes shall be resolved in a court of competent jurisdiction within San Bernardino County, CA.

Waiver and Release, Express Assumption of Risk, Indemnity, and Voluntary Consent Agreement

In full consideration of Fear Farm Haunt LLC, its owners, partners, affiliates, employees, contractors, and assigns permitting me to participate in Fear Farm Haunt’s attractions (the “Experience”), I, on behalf of myself and my heirs, executors, and representatives (the “Releasing Party”), acknowledge and agree as follows:

Waiver and Release

The Releasing Party releases and discharges Fear Farm Haunt and its affiliates (collectively, the “Releasees”) from all liability, claims, and damages of any kind arising out of participation, including negligence, personal injury, property damage, or death. This includes liability related to:

  • Haunted hayride wagons and farm equipment

  • Haunted barn structures and obstacles

  • Scare actors, special effects, or props

  • Slip, trip, and fall hazards on farm property

Emergency Medical Consent

The Releasing Party authorizes Fear Farm Haunt staff or medical personnel to provide or arrange emergency medical care if needed and agrees to hold Releasees harmless for such actions.

Express Assumption of Risk

Participation involves extreme risks including fog, strobe lights, loud noises, confined spaces, uneven farm terrain, actors in close proximity, and other physical/emotional stressors. Risks may include injury, disability, or death. By entering, you acknowledge these risks and voluntarily accept them.

Participation is not recommended for pregnant women, guests with heart/back conditions, epilepsy, asthma, claustrophobia, or any condition that may be aggravated by intense physical or emotional activity.

Communicable Disease Notice

An inherent risk of exposure to COVID-19 or other communicable diseases exists in any public space. By attending, you voluntarily assume all related risks and release Fear Farm Haunt from liability associated with illness or transmission.

Media Release

You consent to the recording, photographing, or filming of your participation at Fear Farm Haunt. Releasees may use your likeness, voice, and image for promotional purposes in any media worldwide without compensation.

Indemnity & Hold Harmless

The Releasing Party agrees to defend, indemnify, and hold harmless Fear Farm Haunt and its affiliates from any claims, damages, or liabilities arising out of participation or violation of this agreement.

Voluntary Participation

By purchasing a ticket and entering Fear Farm Haunt, you acknowledge that participation is voluntary and at your own risk. You certify that you are physically and mentally able to participate and that you understand these terms fully.

ALL SALES ARE FINAL NO REFUNDS. I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND ACKNOWLEDGE THAT I AM WAIVING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS DOCUMENT VOLUNTARILY AND INTEND IT TO BE A COMPLETE RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.
